These Terms constitute a legally binding agreement between you and Dynasty 8 Real.Estate concerning your use of our property listing and management platform.

2. Description of Services

Dynasty 8 Real.Estate is a comprehensive property platform that allows users to:

• Browse property listings for sale, rent, and lease across South Africa
• Create and manage property listings (subscription required)
• Access property management tools and dashboards
• Use financial calculators for mortgage, affordability, and property rates
• Connect with property agents and potential buyers/tenants
• Access due diligence resources and property reports

3. Account Registration

3.1 Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract. By registering, you represent and warrant that you meet these requirements.

3.2 Account Information

When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Account Security

You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. Subscription Plans and Payments

4.1 Subscription Tiers

We offer the following subscription plans:

• Basic: One-time payment for single property listing (1 day access)
• Standard: Recurring subscription for up to 5 properties (30-day listing duration)
• Premium: Recurring subscription for up to 10 properties (90-day listing duration) with full dashboard access
• Enterprise: Custom solutions for large organizations (contact sales)

4.2 Payment Processing

All payments are processed securely through Creem.io, our third-party payment processor. By subscribing, you agree to Creem.io's Terms of Service and Privacy Policy. We do not store complete credit card information on our servers.

4.3 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled
• Standard plan: Billed every 30 days
• Premium plan: Billed every 90 days
• You authorize us to charge your payment method for all applicable fees
• Prices are subject to change with 30 days notice

4.4 Free Browsing

Property browsing and searching is completely free. Subscriptions are only required for listing properties and accessing premium dashboard features.

5. Cancellation and Refund Policy

5.1 Subscription Cancellation

• You may cancel your subscription at any time through your account dashboard
• Cancellation takes effect at the end of your current billing period
• Your listings will remain active until the end of your paid billing period
• No partial refunds for unused time during the current billing period

5.2 Refund Policy

Processing Time: Approved refunds will be processed within 5-10 business days to the original payment method used for the purchase.

Exceptions: We reserve the right to deny refund requests that abuse our refund policy or where service has been substantially used.

6. User Conduct and Responsibilities

6.1 Prohibited Activities

You agree not to:

• Post false, misleading, or fraudulent property listings
• Impersonate any person or entity
• Use the platform for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the platform or servers
• Harvest or collect user information without consent
• Upload malicious code, viruses, or harmful content
• Spam, solicit, or advertise unauthorized services
• Infringe on intellectual property rights of others

6.2 Property Listing Requirements

When listing properties, you agree to:

• Provide accurate and truthful property information
• Only list properties you are authorized to represent
• Upload only high-quality, authentic images of the property
• Comply with all applicable real estate laws and regulations
• Update listing status promptly when a property is no longer available
• Not discriminate against any protected classes under South African law

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of any content you submit to the platform, including property listings, images, and descriptions. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting our Services.

7.2 Platform Content

All content on our platform, including text, graphics, logos, and software, is the property of Dynasty 8 Real.Estate or our licensors and is protected by intellectual property laws. You may not reproduce, modify, or distribute our content without express permission.

7.3 Trademarks

Dynasty 8 Real.Estate and our logos are trademarks of our company. You may not use these marks without our prior written consent.

8. Termination

We reserve the right to suspend or terminate your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9.2 Property Listings

We do not verify the accuracy of property listings posted by users. You acknowledge that all property transactions should be conducted with appropriate due diligence, and we recommend verifying all property information independently.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNASTY 8 REAL.ESTATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dynasty 8 Real.Estate and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiations. If such negotiations fail, the dispute shall be subject to the exclusive jurisdiction of the courts of South Africa.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
